Tips regarding the process of Status Regulation

In order to facilitate the process of Status Regulation of your beloved I decided to give you several important tips that will accompany you through the process.

First and most important – before making your first approach to the Ministry of the Interior to submit an application – it is warmly recommended to consult an attorney specializing in this field.

How does one identify an attorney that specialized in this field? 

An attorney specializing in Regulation of Status – is familiar with the procedures of the Ministry of the Interior.

An attorney specializing in Regulation of Status – knows which documents you must bring with you to the Ministry of the Interior.

An attorney specializing in Regulation of Status – engages mainly in this field and does not engage in four or five other fields, and if he/she does – he/she is not the attorney suitable for you!

An attorney specializing in Regulation of Status is familiar with all the process stages of obtaining a visa.

An attorney specializing in Constitutional-Administrative Regulation of Status – knows that one must not rush to Court with an administrative petition and will not encourage you to do so, on the contrary, he/she will act in the right manner prior to lodging a petition.

Tip – It is important that the attorney you have chosen will accompany you to each and every meeting at the Ministry of the Interior. You should appear at the Ministry of the Interior only accompanied by your attorney.

An important Tip – Regulating the status of your beloved must be handled before his/her visa expires - the longer your beloved stays in the country without a visa, the more difficult it will be to regulate his/her status.

If your beloved is in Israel without a visa – it is possible to handle his/her regulation of status however, in this case weight is ascribed to the reasons and circumstances that have led to this situation.

An important point – when the spouse leaves the country with the involvement of the Ministry of the Interior, it is better if you travel to his/her country, or to another foreign country, and after your wedding ceremony, you invite him/her to Israel. Following his/her arrival – the procedure of regulating the status will continue. In such cases importance is ascribed to the specific circumstances of the matter and legal advice will be provided according to the circumstance.

It is important to know – the more one progresses in the procedures of upgrading the status – also after the marriage – difficulties on the part of the Ministry of the Interior will emerge an attorney specializing in the field will know how to cope with them.

For the meeting with the attorney, the following should be prepared – your Identity Card, the passport of your beloved, certificates from your beloved's origin country – birth certificate, familial status, certificate of good character, change of status, marriage certificate, divorce certificate.

It is recommended to prepare family members, neighbors and friends that they will be requested to appear at the attorney's office, submit affidavits + a copy of their Identity Card.

Prior to filing an application at the Ministry of the Interior –

The following are worth preparing:

Shopping receipts – for each purchase that has been made – particularly for the house – you should have a receipt which includes your name and the name of your beloved – this will help proving a "common life".

The lease for the apartment should be on both names – your name and the name of your beloved. If the apartment is registered on your name or on the name of another family member – you should obtain the affidavit of the House Committee stating that both of you reside in the apartment.

A Tip – Open a joint account at the Postal Bank.

A Tip – Ask family member and friends from abroad to send written mail to the common address and keep the envelopes!!!

A Tip – Take out call printouts from the telephone company – for the period in which you were in contact prior to submitting an application, in order to prove the existence of a relationship and the duration of the relationship.

A Tip – Take out Skype/Facebook call printouts– for the period in which you were in contact prior to submitting an application in order to prove the existence of a relationship and the duration of the relations. 

A Tip – Ensure in advance that the passport of your beloved is in effect for at least two years ahead – this will save a lot of trouble and delays later on.

A Golden Tip – It is worthwhile making an organized list of the chronological events – when and where you met, the number of your spouse's entries to and exits from Israel and for how long he/she stayed, the number of your travels to his/her origin country. Central landmarks in your relationship and common life – such a list will constitute your basic document that will assist you later on in all the stages at the Ministry of the Interior.
